Terms & Conditions – Furulund Drifting

Introduction
This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Consumer rights in Norway and the EU are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-Commerce Act. These laws grant the consumer inalienable rights.
The terms of this agreement are not to be understood as a limitation of the consumer’s statutory rights but outline the main rights and obligations of the parties in the transaction.
These terms are based on the recommendations of the Norwegian Consumer Authority (Forbrukertilsynet).

1. The Agreement
The agreement consists of these terms and conditions, the information provided in the ordering system, and any separately agreed terms. In case of conflict, specifically agreed terms shall prevail, provided they are not contrary to mandatory legislation.
2. The Parties
Seller: Furulund Drifting, Org. no. 929 619 935, 3282 Kvelde, Norway (hereafter “Seller”).
Buyer: The consumer placing the order (hereafter “Buyer”).
3. Price
The stated price includes all taxes and additional costs. Any costs not disclosed before purchase shall not be borne by the Buyer.
4. Conclusion of Agreement
The agreement is binding once the Buyer submits the order, unless there has been an obvious error (e.g., typo in pricing).
5. Payment
The Seller may request payment when the goods are dispatched. For payments via Dintero or Vipps eCom, the amount may be reserved at order and charged upon dispatch.
6. Delivery
Delivery is completed when the Buyer or their representative has received the goods. Unless otherwise specified, delivery shall take place within 30 days of order.
7. Risk of Goods
The risk of goods transfers to the Buyer once delivery has been completed in accordance with Section 6.
8. Right of Withdrawal
Unless exempt, the Buyer has a 14-day right of withdrawal in accordance with the Norwegian Right of Withdrawal Act. The Buyer must notify the Seller in writing (form, email, or letter).
The right of withdrawal applies from:

Single goods: the day after delivery.

Subscriptions: the day after first delivery.

Multiple deliveries: the day after the final delivery.
Return costs are borne by the Buyer unless otherwise agreed. The Buyer may test the goods reasonably; excessive use may result in liability for reduced value.
The Seller will refund the purchase price within 14 days of notification, but may withhold refund until goods are returned.
9. Delay and Non-Delivery
If the Seller does not deliver on time, the Buyer may:

Demand delivery

Cancel the purchase

Claim damages
The Buyer must notify the Seller in writing.
10. Defective Goods
If goods are defective, the Buyer may:

Withhold payment

Demand repair or replacement

Demand a price reduction

Cancel the purchase

Claim damages
Complaints must be made within a reasonable time, and no later than 2 years (5 years if goods are meant to last longer).
11. Buyer’s Breach of Contract
If the Buyer fails to pay or fulfill obligations, the Seller may:

Withhold delivery

Demand payment

Cancel the purchase

Claim damages
Late payment may incur interest, collection fees, and charges for uncollected goods.
12. Warranty
Any warranty offered provides additional rights beyond the Buyer’s statutory rights under Norwegian law.
13. Personal Data
The Seller is the data controller for personal data. Data is only collected to fulfill the agreement, unless the Buyer has given explicit consent for other use.
14. Limitation of Liability
To the fullest extent permitted by law:

The Seller shall not be liable for indirect, incidental, or consequential damages, including loss of profit.

The Seller’s total liability shall not exceed the purchase price paid.

The Seller is not responsible for delays caused by force majeure (e.g., natural disasters, strikes, pandemics, governmental restrictions).
15. Dispute Resolution
Complaints should be addressed to the Seller within a reasonable time. The parties shall seek amicable resolution. If unsuccessful, the Buyer may contact the Norwegian Consumer Council (www.forbrukerradet.no) or the European Commission’s ODR platform (http://ec.europa.eu/odr).
